Property & Land Law

We advise on the acquisition, titling, certification, leasing, and development of land under the Basic Agrarian Law (UUPA) and its implementing regulations, together with the licensing frameworks that govern development in Indonesia's major urban and resource-adjacent regions. Indonesian land titling recognises several distinct categories of right — freehold (Hak Milik), right to build (Hak Guna Bangunan), right to cultivate (Hak Guna Usaha), and right to use (Hak Pakai) chief among them — each with its own eligibility requirements, duration, and renewal process, and each capable of generating disputes when a transaction is structured without full regard for which right actually attaches to the land in question.

Land matters in Indonesia carry a particular density of historical and administrative complexity. Overlapping claims, unregistered customary rights, boundary discrepancies between a certificate and the land it purports to describe, and gaps in the chain of title are common rather than exceptional, particularly in regions — East Kalimantan among them — where rapid development has outpaced the administrative capacity to fully formalise land records. A title that appears clean on its face often is not, and our practice is built on verifying what a document claims against what the record and the field actually show: we conduct due diligence that goes beyond the certificate itself, examining the chain of prior transactions, the underlying measurement and boundary documentation, and, where relevant, the land's zoning and permitted use.

We advise developers, investors, and individual clients on acquisition structuring, leasing arrangements, and the licensing — building permits, location permits, and environmental approvals — that development requires, and we represent clients in disputes arising from defective title, boundary conflicts, and breach of sale and purchase agreements for land and property. Few transactions carry as much latent risk as a land transaction that looks straightforward at signing, and few areas of practice reward thoroughness over speed as consistently as this one does.
