Administrative & Regulatory Law

We represent clients before the State Administrative Court (PTUN) and in dealings with government bodies whose licensing decisions, permits, and administrative acts (KTUN) bear directly on a client's commercial or personal interests. Administrative law is frequently the quiet precondition for everything else a business does: the licence that permits an operation to run, the permit that allows a building to be occupied, the approval without which a transaction cannot close — each is an administrative decision, each is capable of being delayed, conditioned, or revoked, and each is capable of being challenged when the authority that issued or withheld it has acted beyond its lawful power or without the procedural fairness the law requires.

We advise clients on the licensing and approval processes across the sectors in which they operate, anticipating the regulatory requirements a venture will face before they become obstacles rather than planned steps, and we represent clients in challenging administrative decisions — a licence refusal, a permit revocation, a regulatory sanction — before the PTUN, where the standard of review turns on whether the decision was issued within the authority's competence, through the correct procedure, and consistent with the principles of good governance that Indonesian administrative law has increasingly come to recognise.

A licence delayed or revoked can undo years of otherwise sound commercial planning, and the businesses most exposed to this risk are often the ones least prepared for it, having treated regulatory compliance as a box to be checked once rather than a relationship to be managed continuously. We advise with that leverage in mind, both in seeking approvals in the first instance and in challenging decisions that were wrongly made, and we treat the relationship between a client and its regulators as one that deserves the same strategic attention as any commercial negotiation — because, in practical effect, it frequently is one.
